These Terms and Conditions (“Terms”) govern your use of the website at thepolopoint.com and your purchase of products from The Polo Point (“we”, “us”, “our”). By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.
These Terms are governed by and construed in accordance with applicable European Union consumer law, including but not limited to: EU Directive 2011/83/EU (Consumer Rights), EU Regulation 2016/679 (GDPR), and the EU Directive 1999/44/EC (Sale of Goods).
1. About Us
The Polo Point is an online fashion retailer specialising in premium American heritage sportswear. Our registered business email is legal@thepolopoint.com.
2. Eligibility
You must be at least 18 years of age to place an order on our website. By placing an order, you confirm that you meet this requirement.
Our products are sold for personal, non-commercial use only. We reserve the right to refuse or cancel orders that appear to be for commercial resale.
3. Product Information & Pricing
We make every effort to display product images, colours, and descriptions accurately. However, your screen's colour reproduction may vary, and we cannot guarantee exact colour matches.
All prices are displayed in Euros (€) and include VAT where applicable. Prices are subject to change without notice. The price at the time of placing your order is the price you pay.
We reserve the right to correct pricing errors. If we discover an error after your order has been placed, we will notify you and offer you the choice of proceeding at the correct price or cancelling your order for a full refund.
4. Orders & Contract Formation
Placing an order constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation email confirming dispatch of your goods.
We reserve the right to decline or cancel any order for reasons including, but not limited to: product unavailability, pricing errors, suspected fraud, or failure to meet payment verification requirements.
You may cancel your order free of charge before it has been dispatched by contacting support@thepolopoint.com.
5. Payment
We accept major credit and debit cards (Visa, Mastercard), and other payment methods as displayed at checkout. All payments are processed securely through our payment provider.
By submitting an order, you confirm that the payment details you provide are correct and that you are authorised to use the payment method.
We use industry-standard encryption (TLS/SSL) to protect your payment information during transmission.
6. Delivery
Estimated delivery times are provided at checkout and in your order confirmation. These are estimates only and not guaranteed.
Risk in the goods passes to you upon delivery to the shipping address provided. Title passes upon full payment.
We are not responsible for delays caused by customs, extreme weather, or other circumstances beyond our control.
7. Your Right to Cancel (EU Consumer Rights)
Under EU Directive 2011/83/EU, you have the right to cancel your order within 14 calendar days of receiving your goods, without giving any reason. Our policy extends this to 15 days.
To exercise this right, notify us at support@thepolopoint.com within the cancellation period. You will receive a full refund, including standard delivery charges, within 14 days of us receiving the return.
You are responsible for the cost of returning goods unless the item is faulty or incorrectly described (in which case we cover return costs).
This right does not apply to: sealed goods opened after delivery for hygiene/health reasons (e.g. innerwear), or items clearly personalised or custom-made.
8. Statutory Warranty (EU Sale of Goods)
Under EU law, you are entitled to a statutory 2-year guarantee from the date of delivery for goods that are defective or not as described.
If a product is faulty within the first 12 months of purchase, we will assume the fault existed at the time of delivery unless we can prove otherwise.
To make a warranty claim, contact support@thepolopoint.com with your order number and a description (and photo) of the defect.
9. Intellectual Property
All content on this website — including logos, text, images, product descriptions, and design — is the property of The Polo Point and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or commercially exploit any content from this website without our prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law, our liability to you shall not exceed the total value of your order. We are not liable for indirect, incidental, or consequential losses arising from your use of our website or products.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
11. Governing Law & Disputes
These Terms are governed by applicable EU consumer law. You retain the right to seek redress under the consumer protection laws of your country of residence.
We are committed to resolving disputes amicably. If you have a complaint, please contact support@thepolopoint.com. Unresolved disputes may be referred to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
12. Changes to These Terms
We may update these Terms from time to time. The date of the most recent revision appears at the top of this page. Continued use of our website after a change constitutes acceptance of the new Terms.
